1) Who we are & scope
Verixion LLC is a New Mexico–registered digital services company based in Santa Fe. This Policy explains how we collect, use, and disclose personal data when you interact with verixion.com (the “Site”) and with us in the course of our business. Our email and postal details appear on the Site’s Contact page.
Relationship to our Terms. This Privacy Policy forms part of our Terms of Service. If these documents conflict, a separate written agreement between you and Verixion (e.g., MSA/SOW) prevails for paid engagements.
2) Roles & applicability
Controller (website & business operations): For data you submit via the Site (e.g., contact form) and routine business correspondence, Verixion LLC acts as a controller.
Processor (client projects): Where we handle data strictly under a client agreement, we act as a processor and the applicable Data Processing Addendum governs.
3) What data we collect and why
Contact form: name, work email, company, message, consent. Purpose: responding to inquiries, scoping work, and managing pre-contract steps.
Operational email: messages sent to info@verixion.com are processed for routine business correspondence and record-keeping.
Server logs (security & diagnostics): IP address, user-agent, referrer, pages visited, timestamps, and similar metadata generated by our hosting/security stack. Purpose: operate the Site, enforce our Acceptable Use rules, prevent abuse/fraud, and ensure security & performance.
Feedback/submissions: ideas, comments, or materials you voluntarily send us (which may incidentally contain personal data). Purpose: respond to you and improve our Site/services, consistent with our Terms of Service. Please do not send confidential or sensitive information via the Site.
Analytics: privacy-friendly, aggregate analytics to understand overall traffic and detect anomalies. We do not build user-level behavioral profiles.
Cookies: only those strictly necessary for operation and performance (e.g., caching, security). We do not run ad tech or behavioral advertising.
4) Lawful basis (where applicable)
Contract / pre-contract (handling your inquiry and requested steps).
Legitimate interests (operating the Site, security, performance, abuse prevention, and running our business).
Legal obligation (e.g., processing IP notices or responding to lawful requests).
Establishment, exercise, or defense of legal claims (where applicable).
Consent (where required; you can withdraw at any time).
5) Do Not Track & Global Privacy Control
We do not engage in behavioral advertising and our practices are unchanged by Do Not Track (DNT) signals. If our practices change in the future, we will honor applicable opt-out preference signals, including Global Privacy Control (GPC), as required by law.
6) Children’s privacy
Our services and Site are not directed to children under 13, and we do not knowingly collect personal data from children under 13.
7) Retention
Contact-form messages: retained up to 24 months (longer if a client relationship starts, then business/legal retention applies).
Server logs: retained up to 12 months (shorter or longer where necessary for security, investigations, or legal obligations).
Operational email and business records: retained in line with customary business, tax, and accounting requirements.
DMCA/IP notices and related correspondence: retained as required by law and for the establishment, exercise, or defense of legal claims.
8) Sharing & disclosures
We do not sell personal data and we do not sell or “share” personal information for cross-context behavioral advertising. We may disclose information:
to service providers that process data on our behalf under written contracts (e.g., hosting, email, security/analytics);
to courts, regulators, law enforcement, or other third parties where required by law or necessary to protect our rights, users, or the security of the Site;
in connection with a business transaction (e.g., merger, acquisition, financing, or sale of assets), subject to appropriate protections.
9) Security & incidents
We use HTTPS and industry-standard technical and organizational measures appropriate to our size and risk profile. No method is 100% secure. If a data incident affects your personal data, we will notify you and (where required) regulators as required by applicable law.
10) International transfers
Processing may occur in the U.S. and in other countries where our service providers operate. Where required, we implement appropriate safeguards recognized by law (e.g., standard contractual clauses offered by vendors) and apply data minimization.
11) Your privacy rights
Your rights depend on your location and the laws that apply to us at the time of your request. You may request access, correction, deletion, or restriction of your personal data by emailing info@verixion.com. We verify requests to protect your data and respond within timeframes required by law.
U.S. state privacy laws
As of the date above, we do not believe we meet the applicability thresholds of certain state privacy laws (e.g., California CPRA, Colorado CPA, Virginia VCDPA). If and when we do, we will comply with those laws’ additional disclosures and rights (including “Do Not Sell/Share” and sensitive-data rules). Regardless, we will endeavor to honor reasonable requests consistent with our resources and legal obligations.
EU/UK residents (if applicable)
If we offer services to or monitor the behavior of individuals in the EU/EEA or UK, we will comply with the GDPR/UK GDPR, including appointing an EU/UK representative where required by Article 27 and providing additional rights (e.g., data portability and the right to lodge a complaint with a supervisory authority).
